ICE I-9 Inspection for Milwaukee-Area Employers: A Useful Response Starts With the Records

An ICE I-9 Notice of Inspection has specific requirements and deadlines. Milwaukee and Waukesha employers can organize a careful response using their actual records.

What should you do first?

When an employer receives an official demand to produce Forms I-9, the first useful move is to establish exactly what the notice requires, when production is due, which employees and time periods it covers, and which documents actually exist. The question is not whether a company has a Polish owner, Polish-speaking staff or employees who came from abroad. Federal employment-verification rules generally apply to covered employees regardless of nationality. The legal analysis concerns the employer’s actual verification process and what the government is requesting. A manufacturer in Greenfield, a service business in Waukesha and a contractor in Brookfield may have very different workforce files. They still need an orderly and accurate response built from their real records.

Identify the government notice before responding

Read the entire document and identify the issuing agency, date and time of service, proposed inspection date, the forms sought and any additional records requested. An ICE administrative Notice of Inspection (NOI) is a specific process. A judicial warrant, subpoena or other request may raise different questions and should not automatically be handled as the same document.

ICE guidance explains that employers are ordinarily given at least three business days to produce Forms I-9 following service of an NOI, absent legally applicable exceptions. Do not infer a deadline from a website article. Determine the actual date of service, any valid extension or special instruction, and the precise legal instrument.

Useful records: The full notice and attachments; service envelope or transmission; agency contact; employer correspondence; any prior inspection or settlement information.

Reconstruct the real Form I-9 population

Start with current employees and workers who left within the period for which the employer was required to retain Forms I-9. The retention baseline is generally the later of three years after hire or one year after employment ends. Records outside the retention requirement require separate attention; do not automatically treat missing old documents as current violations.

Obtain an accurate employee roster, dates of hire and termination, payroll and hiring records, and the I-9 repository. If files are split among HR software, franchise locations, payroll vendors or paper binders, identify the actual source system and designated custodians.

For businesses operating across Milwaukee, Cudahy, West Allis, Oak Creek and the Waukesha suburbs, the central issue may be inconsistent file storage, not a different immigration rule for each municipality.

Correcting errors is different from rewriting history

A lawful internal review can identify blank fields, inconsistent hire dates, missing employer signatures or forms that were completed using an outdated process. USCIS guidance generally contemplates corrections that preserve the original information, identify who made the change and date the correction. In some situations a new form or section may be prepared and attached with an explanation.

Do not backdate, alter original entries without an audit trail, destroy forms, or create documentation falsely suggesting an earlier examination of identity or employment authorization. Counsel should review how to respond to errors already found, taking account of the actual stage of the government inspection.

An employer reviewing records should not demand a particular immigration document solely because a worker has a Polish name, speaks Polish or has an accent. The employee normally chooses from the legally acceptable documents, and federal anti-discrimination rules can be implicated by overdocumentation and unequal treatment.

The Department of Justice explains that workers generally select which acceptable documents to present for Form I-9. An employer should not demand a particular green card or more documents because of citizenship, national origin or a Polish accent. See 8 U.S.C. § 1324b(a)(6) and DOJ Immigrant and Employee Rights Section guidance.

Form I-9, E-Verify and an immigration petition are not substitutes for each other

A company may have a pending H-1B petition, an EB-3 recruitment process, an intracompany transferee, or an E-1/E-2 employee. Those legal pathways do not eliminate Form I-9 requirements for a covered hire. E-Verify participation, where applicable, has its own terms and requirements, and it is not interchangeable with Form I-9 completion and retention.

For a Polish-owned business in Waukesha or New Berlin hiring employees in Wisconsin, this distinction is worth resolving proactively, before a government request arrives.

Organize the response around a defensible file

A productive employer work plan may include:

The goal is an accurate, organized response that gives the company an actual basis for legal review and, where available, correction.

  • Preserve the notice and establish the deadline. Identify exactly which office is requesting what.
  • Inventory the affected employees. Match the relevant roster to required retention periods.
  • Collect actual existing forms and source records. Preserve originals and the audit trail.
  • Review errors without rewriting the past. Distinguish correctable technical issues from substantive compliance questions.
  • Control communications and production. Designate a responsible contact, track each document supplied and retain production copies.
  • Respond to further agency findings. Evaluate any notice of technical or procedural failures, intent-to-fine notice or settlement communication on its own terms.

Frequently asked questions

Is a Notice of Inspection the same thing as a search warrant?

No. The document's legal nature matters. An administrative records inspection and a search under a warrant raise different questions.

How much time does an employer have after an ICE I-9 inspection notice?

ICE's published general guidance says at least three business days to produce the requested I-9 forms after service of an NOI; the actual notice, legal exceptions and applicable requirements control.

Can we fix an I-9 mistake after finding it?

Some mistakes may be corrected with proper dating and documentation. A correction should never be disguised as an entry made on the original hire date.

Can a company tell Polish employees to bring their green cards when others are not asked?

Selective or excessive document demands can violate federal employer-verification anti-discrimination rules. Employers should follow the correct document-choice process consistently.

Does an approved employment-immigration petition substitute for Form I-9?

No. Petition requirements and employer verification obligations are separate.
